What the new laws mean for your condominium

The revised condo laws aim at better protecting condo owners (Bill 141) and reinforcing building maintenance (Bill 16). These laws specify 4 main obligations for condo syndicates:

Contingency fund

This fund must cover maintenance, repair and renovation costs of the property's common areas.

The amount must be calculated by a contingency fund study conducted every 5 years by a certified professional.

Maintenance log

The maintenance log details the building's characteristics and helps assess the contingency fund. The syndicate must use it to document the building's history, including any completed and upcoming work.

Sufficient insurance coverage

The condo syndicate's insurance policy must cover:

  • The building's reconstruction value reassessed every 5 years by a member of the Ordre des évaluateurs agréés du Québec
  • The building's common areas (ex. lobby, elevator, terrace)
  • The original condition of each unit
  • The syndicate's and managing staff's civil liability

Self-insurance fund

This fund must cover the highest deductible of the syndicate's insurance policy in the event of a claim.
