Are you eligible?

To be eligible for the Home Buyer’s Plan (HBP), you must answer "NO" to the two following questions:

  1. Have I been an owner-occupant in the last five years?
  2. Do I presently have a spouse? If yes, has my spouse been an owner-occupant in the past 5 years, since our marriage or the beginning of our common-law relationship?

A disabled person or one of his/her relatives may apply for the HBP even if the 5-year rule is not met, on condition that he/she is eligible for the tax credit for a disabled person and is buying a home with access better adapted to his/her needs.

For the purposes of the HBP, any two people, regardless of sex, are considered common-law spouses if they have lived together in a conjugal relationship for at least one year or as soon as they become natural or adoptive parents of a child. Given this definition, a person may actually have two spouses-one legal and one common-law!
