The contest will run from September 22, 2008 (12:01 a.m. Eastern) to December 19, 2008 (11:59 p.m. Eastern) (hereinafter the "contest period"). It is being held by Desjardins Card Services (DCS), a business unit of the Fédération des caisses Desjardins du Québec (hereinafter "the Fédération"). There are 2 separate At Your Service contests: At Your Service - Sales Category and At Your Service - Activation Category. This document sets out the rules of the At Your Service contest - Activation Category.
Eligibility
This contest is open to residents of Canada who have reached the age of majority in their province of residence and hold a VISA Desjardins card or will become holders of one of the following VISA Desjardins cards (eligible VISA cards) during the contest period:
The following are not eligible to enter the contest: employees, agents and representatives of the Fédération des caisses Desjardins du Québec including DCS, and any other Desjardins Group entity, including but not limited to, their subsidiaries, advertising and promotional agencies, suppliers of prizes, materials and services related to this contest, as well as all members of their immediate family (brothers, sisters, children, father, mother), their legal or common-law spouse, and all other persons residing with these employees, agents and representatives. This exclusion is applicable throughout the promotion period and the draw.
How to enter
Interest charges, annual fees, balance transfers, regular and promotional VISA Desjardins cheques, and cash advances are not considered purchases. Only purchases and Accord D financing arranged through a merchant or caisse, by telephone, or online, and communicated to DCS during the contest period will be accepted. DCS is not responsible for purchases registered by a merchant with DCS after the contest closing date and time.
No purchase required. Cardholders who wish to participate with no purchase or obligation may do so by handwriting their name, address (including city and postal code), telephone number, date, and the first 8 digits of their VISA Desjardins credit card number legibly, along with a handwritten essay of at least 100 words on “The advantages of making purchases with a VISA Desjardins card” and mailing both items with sufficient postage to the following address: Desjardins Card Services, At Your Service contest - Activation Category - no-purchase entry, 425 Viger Avenue West, Montreal, Quebec, H2Z 1W5. Maximum of 1 entry per envelope bearing sufficient postage. No-purchase entries must be postmarked no later than the last day of the contest: December 19, 2008. Each letter received shall be automatically registered for one (1) contest entry. Entries thus received shall be subject to the same conditions as those applicable to other entries. Mechanical reproductions are not permitted. Entries become the property of DCS and will not be returned.
Prizes
There are five (5) prizes, each consisting of a $500 account credit for payment of the services of an expert such as a gardener, sommelier, chef, domestic helper, designer or other expert service legally acceptable to DCS.
To claim a prize, winners must comply with these rules and submit a copy of their bills documenting the provision of services by an expert, by mail, e-mail or fax, no later than June 19, 2009, in order to receive their account credit. After such date,
winners irrevocably forfeit their claim to an account credit or any remaining portion thereof, if any. Following submission of a copy of the bill for provision of services, a credit equal to the amount of the bill shall be applied to the winner's
account, to a maximum of $500. Each bill for provision of services shall be exchanged for an account credit equal to the amount of the bill to a maximum of $500, including taxes.
If a winner is not interested in procuring the services of an expert, he or she may opt to receive an account credit equal to the $500 prize value by submitting his or her request no later than June 19, 2009, after which date he or she irrevocably
forfeits his or her prize claim.
Regional distribution of prizes
Entries for each region shall be determined on the basis of participants' addresses of residence, according to the information contained in the DCS file. Different lists will be created for this purpose. One prize will be awarded per region. Only 1 prize will be awarded per winning entry.
Draw
Five (5) eligible entries will be selected by random electronic draw—1 for each of the regions—from all entries received during the contest period. The drawings will be held on January 15, 2009 at 4:00 p.m. (Eastern) at the DCS offices located at 425 Viger Avenue West, Montreal, Quebec, H2Z 1W5.
Should a person be deemed ineligible for a prize before it is awarded, he or she will be disqualified. In such case, another entry will be selected at random until a new participant is selected and declared a winner.
The odds of a participant being randomly selected depend on the number of eligible entries received for each of the 5 regions.
General conditions
Should the selected person fail to meet one of the conditions described in the previous paragraph, he or she will be disqualified and a new draw will be held in accordance with these rules until a new participant is selected and declared a winner.
All mail entries shall be subject to verification by the contest organizers. Any entry that is illegible, incomplete, mutilated, fraudulent, mechanically reproduced, received or made late may be rejected and will be ineligible to win a prize. All decisions of the contest organizers are final and cannot be appealed.
Anyone taking part in this contest or attempting to do so through means that are counter to this rule and are unfair to other participants may be disqualified and referred to competent legal authorities.
Prizes must be accepted as awarded and may not be exchanged, substituted for another prize or transferred to another person. However, the organizers and winners may decide by mutual agreement to convert a prize to an account credit of equivalent value, i.e., $500 per regional prize, for a total of $2,500.
In the event that a prize cannot be awarded for reasons beyond the control of the contest organizers and unrelated to the winner, the organizers will award a similar prize of equivalent value.
Refusal to accept a prize releases the Fédération des caisses Desjardins du Québec, including Desjardins Card Services, any Desjardins Group entity, including but not limited to their respective subsidiaries, advertising and promotional agencies, their employees, agents and representatives, of any obligation with respect to the winner.
The selected person releases VISA Canada, the Fédération des caisses Desjardins du Québec, including Desjardins Card Services, any Desjardins Group entity, including but not limited to their respective subsidiaries, advertising and promotional agencies, their employees, agents and representatives, of liability for any damage he or she may sustain as a result of the acceptance or use of the prize. The selected person acknowledges that once he or she has received his or her prize, the performance of obligations related to this prize becomes the entire and exclusive responsibility of the designated prize supplier. All selected persons agree to sign a Declaration Form prior to being declared winners and to receiving their prizes.
The Fédération des caisses Desjardins du Québec, including Desjardins Card Services, any Desjardins Group entity, including but not limited to their respective subsidiaries, advertising and promotional agencies, their employees, agents and representatives, deny any liability with respect to the malfunction of any computer component, software or communication line, regarding the loss or absence of network communication or any communication that is defective, incomplete, incomprehensible, or deleted by any computer or network, and which may limit or prevent anyone from participating in the contest. The contest organizers, as well as their advertising and promotional agencies, employees, agents and representatives deny any liability with respect to any loss or damage that may be caused directly or indirectly, in whole or in part, by any web page or software download and transmission of any information concerning participation in the contest. They may not be held liable for entries that are lost, misdirected, or delayed because of mail problems or for any other reason whatsoever.
The contest organizers reserve the right, at their entire discretion, to modify, cancel, terminate or suspend this contest in whole or in part in the event of a virus, computer bug, unauthorized human intervention, or any other cause beyond the control of the contest organizers that could corrupt or affect the administration, security, impartiality or normal running of the contest, subject to approval of the Régie des alcools, des courses et des jeux du Québec, for residents of Quebec.
By entering this contest, the winners authorize the organizers and their representatives to use their name, photograph, likeness, prize statement, place of residence and/or voice for publicity purposes, if required, without remuneration.
Entries become the property of Desjardins Card Services and will not be returned to participants at any time.
For residents of Quebec, any dispute regarding the organization or holding of a promotional contest may be submitted to the Régie des alcools, des courses et des jeux for a ruling. Any dispute regarding the awarding of a prize may be submitted to the Régie for the sole purpose of attempting to reach a settlement.
For the purposes of these rules, the participant is the primary VISA Desjardins cardholder, or the person whose name appears on the mail-in entry form, and this person shall be awarded the prize if he or she is selected and declared a winner.
