General conditions
To be declared a winner, the randomly selected contestants must meet the following conditions:
Failure to meet the above-mentioned conditions or any other condition herein, the selected persons will be disqualified and another draw will be held in keeping with these contest rules, until other contestants are selected and declared the winners.
Within fifteen (15) days of receiving the signed Declaration form, contest organizers will forward a letter to the winners informing them on how to take possession of their prize. Refusal to accept the prize by the persons selected releases contest organizers from any and all obligations regarding the awarding of the prizes. In this case and at their only discretion, contest organizers may hold a new draw as described in the previous section.
By accepting the prize, the winners agree to abide by these rules and the decisions of the Fédération, who is conducting the contest, and whose decisions are final and not subject to appeal.
If a winner is a minor and lives in Quebec, the prize may only be claimed with written consent of one of his parents or guardians, who must confirm the contestant's age and compliance with these rules, and release the Fédération des caisses Desjardins du Québec, the Fédération des caisses populaires de l'Ontario Inc. and their caisses and subsidiaries from any liability with respect to damages or losses arising from participation in the contest, the awarding of a prize, its quality, any damages which may occur in transit or its use.
If a winner resides in Ontario, his prize may only be claimed by a parent with whom he resides or by a person who has lawful custody of the winner. In writing, one of these individuals will confirm the age of the contestant, compliance with these rules, receive the prize, and release the Fédération des caisses Desjardins du Québec, the Fédération des caisses populaires de l'Ontario Inc. and their caisses and subsidiaries from any liability with respect to damages or losses arising from participation in the contest, the awarding of a prize, its quality, any damages which may occur in transit or its use.
Prizes must be accepted as described in the present contest rules and cannot be transferred, substituted for another prize or exchanged in whole or in part for cash, except as provided in the section below.
In the event that the contest organizers cannot award the prizes (or a portion of the prizes) as described in these contest rules, they reserve their right to award like prizes (or a portion of the prizes) of equivalent value, or at their sole discretion, the prize cash value as indicated herein, or as the case may be, the portion of prize value.
Each person selected releases the Fédération and the persons on behalf of whom the contest is held from any liability in terms of any loss or damage that could arise from accepting and using their prize. To be declared a winner and prior to the awarding of the prize, the selected persons agree to sign a declaration to this effect appearing in the Declaration form. Any guests accompanying the winner on the trip will also be required to sign this declaration in the Declaration form; otherwise they cannot go on the trip. If any guest is a minor, an adult parent or legal guardian will be required to sign the Declaration form in his or her name.
Selected persons recognize that upon receipt of a letter confirming their prize, the execution of the obligations related to the prize becomes the entire and exclusive responsibility of the various suppliers of products and services. In order to be declared a winner and prior to the awarding of the prize, the selected persons agree to sign a declaration to this effect appearing in the Declaration form. Adult guests (or parents or legal guardians) will also be required to sign this declaration in the Declaration form; otherwise they cannot go on the trip.
The Fédération reserves the right, at its sole discretion, to terminate this contest should circumstances beyond its control should prevent it from continuing. It shall not be held liable in such an event.
The Fédération and the persons on behalf of whom the contest is held shall accept no liability whatsoever for missing, lost or late entries or for any postal service-related problem, of for any breakdown of the Web site for the duration of the contest, including any damage to a contestant's computer.
The Fédération and the persons on behalf of whom the contest is held shall accept no liability whatsoever in any event where their inability to act is the result of an event or circumstance that is beyond their control, or of a strike, lockout or any other labour dispute in their establishments or firms whose offices are used to hold this contest.
By accepting the prizes, winners authorize the Fédération des caisses Desjardins du Québec, the Fédération des caisses populaires de l'Ontario inc. as well as their member caisses, subsidiaries and Desjardins Credit Union to their name, address, photo, image, voice and declaration regarding the prize for promotional purposes, without additional compensation.
Personal information obtained from contestants will be used only to administer the contest. No advertising communication or other type of communications unrelated to this contest will be sent to contestants unless the participants have expressly authorized Desjardins to do so on their entry form.
