6.1 - The user agrees and acknowledges that the exchange rate applied to an inter-currency transfer is the exchange rate determined by Caisse centrale Desjardins and in force at the time when he/she confirms the transaction for the last time and a
confirmation number is assigned to the transaction.
6.2 - The user agrees and acknowledges that prior to 8:00 a.m. and after 4:30 p.m. on business days and on Saturdays, Sundays and holidays, the exchange rate applied to an inter-currency transfer may be adjusted upwards or downwards by Caisse centrale Desjardins, at its sole discretion, and that as a result, the exchange rate may be less advantageous for the user.
6.3 - The user acknowledges that an inter-currency transfer can be cancelled only by an offsetting transaction. If an inter-currency transfer must be reversed, for whatever reason, the user agrees and acknowledges that the exchange rate then applicable will differ from the one initially used to make the inter-currency transfer. The user agrees to assume any risk associated with exchange rate changes as well as any direct or indirect loss arising from such transaction. The user therefore relieves the caisse of all liability in this matter.

7.1 - The user agrees and acknowledges that he/she is solely responsible for international money transfers made on an account using the International Money Transfer feature via the AccèsD Internet Service.
7.2 - The user agrees and acknowledges that transactions related to international money transfers, particularly foreign exchange transactions, involve risks, including a risk of loss due to foreign exchange fluctuations.

7.4 - The user agrees and acknowledges that the exchange rate applicable to an international money transfer is the exchange rate determined by Caisse centrale Desjardins and in force at the time the user confirms the transaction and a confirmation number is issued for that transaction.
7.5 - Notwithstanding section 7.4 herein, the user agrees and acknowledges that prior to 8:00 a.m. and after 4:30 p.m. on business days and on Saturdays, Sundays and holidays, the exchange rate applied to an international money transfer may be adjusted upwards or downwards by Caisse centrale Desjardins, at its sole discretion, and that as a result, the exchange rate may be less advantageous for the user.
7.6 - The user agrees that the caisse and its correspondents reserve the right to use the services of financial institutions and correspondents (hereinafter referred to as "intermediaries") to make international money transfers, but that they cannot be held responsible for any delay or error in transmission or for any action beyond their control, including acts or omissions by correspondents, agencies or subsidiaries acting as agents.
7.7 - The user undertakes, if applicable, to pay the fees displayed on screen at the time of any international money transfer. The user agrees to have these fees and the converted amount of the international money transfer, if applicable, debited by the caisse at the time he/she confirms the transaction and a confirmation number is assigned to said transaction, directly from the USD or CAD account indicated by the user.
7.8 - The user agrees and acknowledges that the recipient may be charged fees by intermediaries to carry out the international money transfer, and that these may be deducted from the amount sent. He/she acknowledges that the caisse has no control over these fees.
7.9 - The user also acknowledges that the caisse has no control over the exchange rates applied by the recipient's financial institution when said financial institution is required to perform a currency conversion. The user relieves the caisse of all liability for any direct or indirect loss resulting from such a conversion.
7.10 - The user is solely responsible for any error made during the preparation and transmission of his/her instructions regarding an international money transfer. The caisse can therefore not be held liable for any error arising from incorrect or incomplete information provided by the user.

Monday through Friday from 8:30 a.m. to 5:30 p.m., and this provided the international money transfer is carried out on a business day; if the international money transfer is not carried out on a business day, for example, a Canadian statutory holiday, it is processed on the next business day.

7.13 - If the international money transfer cannot be delivered to the recipient for reasons beyond the caisse's or the intermediaries' control, the funds may be returned by the recipient's financial institution. The user may request an investigation, via the AccèsD Internet Service, if the funds have not been received by the recipient.
7.14 - The user acknowledges that any tracing request involving an international money transfer must be made using the form designated for that purpose through the AccèsD Internet Service and agrees to pay all fees related to this request.

7.16 - The user acknowledges that, notwithstanding section 7.11, an international money transfer that is confirmed by the user and for which a confirmation number has been issued is presumed to have been processed and sent and that therefore said international money transfer cannot be cancelled or modified.
7.17 - In the circumstances prescribed in sections 7.13, 7.14 and 7.16 for returned international money transfers, for whatever reason, the user agrees and acknowledges that the applicable exchange rate may differ from the one initially used to make the international money transfer. The user agrees to assume any risk associated with exchange rate fluctuations as well as any direct or indirect loss arising from such a transaction. The user therefore relieves the caisse of all liability in this matter.

9.5 - Unless the user revokes it, a stop payment on a cheque remains in effect for a maximum period of 190 days from the date the cheque was issued, and a stop payment on a pre-authorized payment remains in effect for a maximum period of 372 days from the date the stop payment order was placed.
9.6 - Unless deleted by the user or caisse, stop payment orders placed by the user remain visible on AccèsD Internet for a maximum period of 190 days from the date the cheque was issued, and 372 days from the date the stop payment order on a pre-authorized payment was placed. The user is responsible for verifying that a stop payment has been processed according to his or her instructions before deleting it.
9.7 - The user acknowledges that the caisse cannot be held liable for any loss or damage that he or she may suffer as a result of an error made when entering the information about the stop payment to be made, or due to the fact that the information entered was incomplete.

13.2 - The user agrees not to divulge any of his/her authentication elements to anyone, in any way whatsoever, nor to write them on any document that may be easily consulted, nor leave them near any accessible device; otherwise, he/she shall be held liable, including for any transactions carried out in violation of an agreement concluded with him/her, or for any fraudulent act relating to his/her rights, up to the daily withdrawal limits.

2.2 The user also acknowledges that the use of his card, as well as the transactions carried out with it are subject to terms and conditions enacted by Desjardins from time to time and agrees to respect, among others, the terms and conditions set forth hereafter.
3.1 The user acknowledges that his phrases, image and personal questions are security features required for authentication, that is, to verify his identity and that of the AccèsD Internet service, and that any AccèsD Internet service login process must be terminated if his personal phrase and image do not appear on the screen.
3.2 The user acknowledges that the use of his card together with his password is equivalent to his authentic signature allowing him to carry out transactions through the AccèsD Internet service (e.g., access to information, change of address, credit limit increase).
3.3 Through the AccèsD Internet service, Desjardins will indicate the following to the user: i) the types of transactions that may be carried out, which can vary depending on the system used; ii) the accounts that may be used to carry out these transactions; iii) the instructions allowing completion of a transaction.
4. Pay your account balance
4.1 Only Canadian currency accounts held at a Canadian financial institution in the name of the user and requiring only one signature may be added to the user's file.
4.2 When the user uses the pay your account balance feature, he understands and accepts that the corresponding amount is immediately debited from his account. However, the user is advised that there may be a delay of one business day before the payment is applied to the credit card account. Business days exclude the following statutory holidays:
4.3 Funds may be held on the credit card account for one to eight days upon an account payment from a financial institution.
4.4 Information provided by the user to the Federation appearing on account statements remains strictly confidential. It will only be used to add an account from a Canadian financial institution so that payments may be made from a financial institution.
4.5 The user understands and accepts that Canadian financial institutions may impose applicable limits on account payments from financial institutions.
5. Password Confidentiality
5.1 The Federation will provide the user with a temporary password to be used in conjunction with the user code assigned to him. This password must be modified by the user during his initial use of the service. The user agrees not to choose a password that can easily be guessed (e.g., birth date, address, postal code), in which case he would be considered to have contributed to the unauthorized use of the user code.
5.2 The user agrees not to disclose his password to anyone, in any way and not to write it on the card itself or on any document that is easily accessible, in which case he will assume the full responsibility of doing so, including transactions carried out in contravention of this agreement or fraud perpetrated using this password.
5.3 In the event that the user realizes the confidentiality of his password has been lost or compromised or as soon as a third party is suspected of knowing the password, the user agrees to change it immediately. Failure to do so will render him responsible for any damages related to transactions carried out using this password.
6. Confidentiality of Phrases, Image and Personal Questions
6.1 To configure his new security parameters and open a session of the AccèsD Internet service, the user must choose a personal phrase and then memorize the randomly assigned image; the user may then change the image. The user must also select three personal questions and answer them. For the purposes of this document, the personal phrase, the image and the personal questions and answers shall collectively be known as “authentication elements.”
6.2 The user agrees not disclose his authentication elements in any way, nor to write them on any document that is easily accessible, in which case he will assume the full responsibility of doing so, including transactions carried out in contravention of this agreement or fraud perpetrated using these elements, up to his daily limits.
6.3 If, during the process of connecting to the AccèsD Internet service, or to a service that appears to be or that the user believes is the AccèsD Internet service, the user notices that his personal phrase or image does not appear, he agrees not to continue connecting, not to enter his password, and to contact the AccèsD Internet service customer service at 1-800-224-7737.
6.4 In the event that the user realizes the confidentiality of one of his authentication elements has been compromised or as soon as a third party is suspected of knowing one of them, the user agrees to change it immediately. Failure to do so will render him responsible for any damages related to transactions carried out using the AccèsD Internet service once a session has been opened using this authentication element.
7. Transaction Confirmation
7.1 The user recognizes that the confirmation number issued by the AccèsD Internet service constitutes the proof that the transaction has been correctly recorded.
7.2 Desjardins, although it may do so, is not legally required to provide any other proof of transaction unless needed by the user to avoid or settle a dispute. If this is the case, the user must provide Desjardins with the transaction confirmation number. The user accepts that the magnetic stripe or equivalent information medium on which data relating to the transaction is recorded constitutes sufficient written proof of a transaction in any legal proceedings.
8. Transaction Accuracy
8.1 The user accepts that the accuracy of transactions carried out through the AccèsD Internet service is subject to verifications and authorizes Desjardins to make the necessary adjustments in the account accessible through the AccèsD Internet service in the event of inaccuracy or a mistake, within 10 business days of such transactions.
9.1 Desjardins cannot assure the confidential nature of transactions carried out by the user on a non-secure system or if the user has not complied with the provisions relating to password confidentiality described in section 5.2 of this document and the security measures spelled out in the site's security policy.
10.1 The user recognizes that Desjardins cannot be held responsible for damages, including monetary losses, arising from the unavailability of the AccèsD Internet service, including the inability to display the authentication elements, misuse or any other AccèsD Internet service interruption caused by actions outside of Desjardins's control, including labour disputes and equipment failure. However, the user shall not be held responsible for monetary losses resulting from technical malfunctions within Desjardins's information technology system.
10.2 The user will not be held responsible for transactions carried out after he was threatened and obligated to divulge his password or user code, providing a complaint is filed with law enforcement, the Federation is immediately notified and full cooperation is given with any ensuing investigation.
10.3 The user agrees to notify Desjardins of any changes to his personal information that could affect the transactions carried out using the AccèsD Internet service (e.g., address, telephone number). The user recognizes that Desjardins cannot be held responsible for damages ensuing from his failure to provide updated information, such as interest charges or fees sent to the cardholder by a product or service provider.
11. Changes to the Terms and Conditions
11.1 The user recognizes that the Federation can modify these terms and conditions unilaterally and without advance notice.
11.2 By carrying out a transaction through the AccèsD Internet service after such a modification or after receiving the AccèsD Internet service Terms and Conditions, the user agrees to the changes and terms and conditions
12. User Code Cancellation
12.1 The user may withdraw from the AccèsD Internet service and terminate this agreement at any time by contacting the Federation according to the instructions in section 13.
12.2 Desjardins may also withdraw the service from the user and terminate this agreement at any time, temporarily or permanently, in which case it will not be held responsible for any losses resulting from this action.
13.1 Any notice needing to be sent to the Federation in accordance with this agreement can be communicated over the telephone by calling 1-877-226-0226.
