1. The "Escape with Cirque du Soleil" Desjardins contest is held by the Fédération des caisses Desjardins du Québec ("the Contest organizers"). It runs on the Internet from August 30, 2007 to September 13, 2008 at 11:59 p.m. (ET) (the "Contest period").
2. The contest is open to all residents of Canada who have reached the age of majority in their province or territory of residence at the time they enter the contest. Are excluded: Employees, agents and representatives of the Contest organizers (Desjardins), of Groupe Cirque du Soleil Inc., of their subsidiaries, affiliated companies, parent corporations, of their advertising and promotional agencies, suppliers of products, materials or services related to this contest, as well as members of their immediate family (brothers, sisters, children, father, mother), their legal or common law spouse, and anyone domiciled with these employees, representatives and agents.
3. No purchase required. During the Contest period, visit the www.desjardins.com/soleil web site and follow the instructions to access the electronic entry form (the "entry form"). Complete the entry form by entering your first name, last name, complete address with postal code, phone numbers with area code, email address, gender, date of birth, the correct answer to the informative question about the Desjardins Group values of as well as the correct answer to the mathematical skill-testing question appearing thereof. You must confirm that you have read the contest rules and that you agree to abide by them. Then, click on the "Submit" box in order to submit your entry form by September 13, 2008 at 11:59 p.m. (ET) at the latest and you will automatically be entered in the prize draw. A page confirming your participation will appear on the screen.
4. Limit of one (1) entry form per person during the whole Contest period. The Contest organizers reserve their right to disqualify any individual who registers or attempts to register more than one (1) entry form during the Contest period. Each entrant must use the same and only one email address during the whole Contest period.
5. To win: One (1) four-day trip for two (2) adults to Las Vegas to attend one of the following shows: Mystère™ , "O™", LOVE™ or KÀ™ or in Orlando to attend the La Nouba™ show, of an approximate retail value of three thousand dollars ($3,000 CND). The trip includes:
5.1 Economy round-trip airfare for two (2) to Orlando or Las Vegas airport, as the case may be. Departure will be from the airport closest to the winner’s residence, among airports located in one of the following cities: Halifax, Moncton, Montreal, Quebec, Ottawa, Toronto, Winnipeg, Régina, Calgary or Vancouver;
5.2 Double occupancy accommodation for three (3) nights in a standard room, at the Contest organizers’ choice, in Las Vegas or in Orlando, as the case may be;
5.3 Two (2) tickets to attend the permanent show of Cirque du Soleil® in Las Vegas or in Orlando, in a section to be determined depending on the availabilities of the tickets at the time of reservation and/or at the Contest organizers’ choice;
6. The following conditions apply to the trip:
6.1 all fees or expenses other than those mentioned above will be at the winner’s charge and/or his/her guest’s charge, including transportation between the residence and the airport of departure, transfers and transportation at destination, room service, beverages (alcoholic or not), meals, trip documents including a valid passport (which is mandatory), airport taxes, insurances (including cancellation and health insurances), gratuities, expenses of a personal nature and tours, as the case may be;
6.2 it is the responsibility of each person being part of the trip to subscribe at his/her own costs to an appropriate travel insurance coverage. In no case, the Contest organizers may be held responsible for healthcare expenses or any other expenses usually covered by such an insurance coverage;
6.3 the trip must be taken on June 1st, 2009 at the latest, otherwise it will be void, except for the following periods: Easter, Christmas and school breaks "Spring break";
6.4 the air carrier and hotel will be at the Contest organizers’ choice;
6.5 all arrangements regarding the trip must be taken by the winner with the Contest organizers, no later than twenty (20) days before the foreseen date of departure. Reservations relating to the stay will be subject to availabilities. Once confirmed, they cannot be modified as for the date, place or choice of guest. In case of a cancellation, all fees relating to such cancellation will be at the winner’s charge and/or guest’s charge;
6.6 the winner and his/her guest must travel together and follow the same itinerary during the trip;
6.7 the guest must have reached the age of majority in his/her province or territory of residence at the time the reservation is made;
6.8 if the prize is not used in whole or in part, no compensation will be awarded to the winner or his/her guest; and
6.9 the approximate value of the prize is based on an average value of the airfare and accommodation, which can vary depending on the date of departure and the chosen destination. No compensation will be awarded or cannot be claimed to such effect.
7. At 11:00 am on September 19, 2008, in Montreal, at the offices of the Contest organizers, a random draw of one (1) eligible entry form will be held, in the presence of at least three (3) witnesses, among all entry forms registered during the Contest period in accordance with section 3 herein, in order to award the prize.
8. The odds that an entry from be drawn at random for the prize depend on the number of entry forms registered during the whole Contest period.
9. In order to be declared a winner, the selected person must:
9.1 be reached by phone by the Contest organizers’ representative within ten (10) days following the random draw;
9.2 have correctly answered to the informative question about the Desjardins Group values and the mathematical skill-testing question appearing on the entry form;
9.3 sign the declaration and release form (the "Declaration form") that will be sent by the Contest organizers by mail, by fax or email and send it back to the Contest organizers within fifteen (15) days following its receipt.
10. Failure to respect the above-mentioned conditions or any other condition herein, the selected person will be disqualified and another draw will be held for the prize, according to the present contest rules, until an entrant is selected and declared winner of the prize. The same rules will apply by making the appropriate changes, as the case may be.
11. Within fifteen (15) days following the receipt of the Declaration form, the Contest organizers will send a letter to the winner in order to inform him/her on how to take possession of the prize. The refusal of the prize by the selected entrant. The refusal of the prize by the selected person releases the Contest organizers from any and all obligations regarding the awarding of the prize. In this case and at their only discretion, the Contest organizers may hold a new draw as described in the previous section.
12. The entry forms and the Declaration form are subject to verification by the Contest organizers. Any entry form or Declaration form which is, as the case may be, illegible, incomplete, mutilated, fraudulent, registered or received late, which does not bear the correct answer to the informative question and to the mathematical skill-testing question or is otherwise not compliant, will be automatically rejected and will not give the right to a registration or to the prize, as the case may be.
13. The Contest organizers reserve their right to disqualify a person or cancel one or several entries of a person who enters or attempts to enter the contest by means contrary to these contest rules or in a manner which is unfair to the other entrants (e.g. computer hacking, exceeding number of entries, etc.). Such a person will not be allowed to receive the prize and could be reported to the competent legal authorities. No entry form submitted by fax or in person or otherwise than in compliance with these Contest Rules will be accepted.
14. The prize must be accepted as described in the present contest rules and cannot be transferred to another person, substituted for another prize or exchanged in whole or in part for cash, except as provided in the section hereunder.
15. In the event that the Contest organizers cannot award the prize (or a part of the prize) as described in the present contest rules, they reserve their right to award a prize (or a part of the prize) of the same nature and equivalent value, or at their sole discretion, the prize cash value as indicated herein, or as the case may be, the portion of prize value.
16. The selected person releases from any and all responsibility the Contest organizers, Groupe Cirque du Soleil Inc., their subsidiaries, affiliated companies, parent corporations, their advertising and promotional agencies, their employees, agents and representatives for any and all damage that he/she can suffer regarding his/her acceptance or the use of the prize. In order to be declared a winner and prior to the awarding of the prize, the selected person agrees to sign a declaration to such effect appearing in the Declaration form. The adult guest (and the parent or legal guardian in the interval) will have to sign such declaration in the Declaration form, otherwise he/she cannot be part of the trip.
17. The selected person recognizes that upon receipt of a letter confirming his/her prize, the execution of the obligations related to the prize becomes the entire and exclusive responsibility of the various suppliers of products and services. In order to be declared a winner and prior to the awarding of the prize, the selected person agrees to sign a declaration to such effect appearing in the Declaration form. The adult guest (and the parent or legal guardian in the interval) will have to sign such declaration in the Declaration form, otherwise he/she cannot be part of the trip.
18. The Contest organizers, Groupe Cirque du Soleil Inc., their subsidiaries, affiliated companies, parent corporations, their advertising and promotional agencies, their employees, agents and representatives are not liable for faulty computer components, software, or communication lines, relating to the loss or absence of network communication or relating to any transmission that is faulty, incomplete, incomprehensible, or erased by any computer or any network that could limit the possibility or prevent any person from entering the contest. The Contest organizers, Groupe Cirque du Soleil Inc., their subsidiaries, affiliated companies, parent corporations, their advertising and promotional agencies, their employees, agents and representatives waive all liability for any injury or damage which could arise directly or indirectly, in whole or in part, from downloading any web page or any software and by the transmission of any data relating to the contest.
19. The Contest organizers reserve their right, at their sole discretion, to cancel, terminate, modify or suspend this contest, in whole or in part, in the case where an event or any human intervention could corrupt or affect the administration, safety, impartiality or the normal running of the contest as foreseen in these contest rules, subject to the approval of the Régie des alcools, des courses et des jeux of Quebec, if required.
20. Should contest entries have to be stopped for any reason whatsoever, in whole or in part, prior to the closing date stated in these contest rules, the draw may be held, at the discretion of the Contest organizers, from among entry forms duly registered since the beginning of the contest to the date of the event putting an end to contest entries.
21. In any case, the Contest organizers, Groupe Cirque du Soleil Inc., their subsidiaries, affiliated companies, parent corporations, their advertising and promotional agencies, suppliers of products, material or services relating to the contest as well as their employees, agents and representatives, will not be held responsible to award more prizes than the number of prizes indicated in these contest rules or to award the prize otherwise than in compliance with these contest rules.
22. By entering or attempting to participate to this contest, any person releases from any and all responsibility the Contest organizers, Groupe Cirque du Soleil Inc., their subsidiaries, affiliated companies, parent corporations, their advertising and promotional agencies as well as suppliers of products, material or services relating to this contest from any and all damages that he/she could arise from participating or trying to participate in this contest.
23. Any attempt to deliberately sabotage the web site of this contest and/or any affiliated web site or to sabotage the outcome of the contest constitutes a civil and criminal law offence. If these types of attempts are conducted, the Contest organizers reserve their right to reject the entry from of the entrant and seek damages in accordance with the law.
24. By entering this contest, the winner authorizes the Contest organizers and their representatives to use, if desired, his/her name, photograph, likeness, declaration related to the prize, place of residence and/or voice for publicity purposes and such without any remuneration. In order to be declared a winner and prior to the awarding of the prize, the selected person agrees to sign a declaration to such effect appearing in the Declaration form. The adult guest (and the parent or legal guardian in the interval) will have to sign such declaration in the Declaration form, otherwise he/she cannot be part of the trip.
25. Entry forms are the Contest organizers’ property.
26. Subject to the present contest rules, no communication or correspondence will be exchanged with entrants regarding their statute.
27. If any section of these contest rules is declared or deemed illegal, unenforceable or invalid by a competent court, that section shall be considered invalid, but all unaffected sections will be applied within the limits of the law.
28. Quebec residents: Any litigation respecting the conduct or organisation of a publicity contest may be submitted to the Régie des alcools, des courses et des jeux for a ruling. Any litigation respecting the awarding of a prize may be submitted to the Régie for the purpose of helping the parties reach a settlement.
29. Any Contest organizers decisions regarding any aspect of this contest, including without restriction the eligibility and/or disqualification of entry forms are final and binding, subject to any decision by the Régie des alcools, des courses et des jeux du Québec in relation to matters under its jurisdiction. By entering this contest, entrants undertake to respect the present contest rules.
30. For the purpose of the present contest rules, the entrant is the person whose name appears on the entry form and it is this person who will be awarded the prize if he/she is selected and declared a winner.
31. Personal information obtained from the entrants will be used only to administer the contest. No advertising communication or other type of communications unrelated to this contest will be sent to the participant unless the participant has expressly authorized Desjardins to do so on his/her entry form.
32. The Contest organizers in no way guarantees that the contest Web site will be accessible or functional without interruption during the Contest period or that it will be free of all errors.
33. Should the French or English version of these contest rules differs, the French version shall prevail.
34. This contest is held and organized by La Fédération des caisses Desjardins du Québec. Groupe Cirque du Soleil Inc. and its affiliated companies are not responsible and cannot be held responsible in any way in connection with the holding and the organization of this contest.
